Terms of Service
These Terms govern your access to and use of Jottey, the invisible AI sales copilot. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Jottey (“Service”) is software that captures your meeting audio locally on macOS, transcribes it in real time, provides live coaching and objective tracking during calls, and produces a post-call scorecard. The Service is operated by Jottey (“we,” “us,” “our”).
2. Eligibility and accounts
You must be at least 18 and able to form a binding contract. You are responsible for maintaining the security of your account and for all activity under it. Provide accurate information and keep it up to date.
3. Acceptable use
You agree not to:
- Use the Service in violation of any law, including recording and wiretap laws (see Section 4).
- Use the Service to capture conversations you have no legal right to record.
- Reverse engineer, resell, or attempt to extract API keys or credentials from the app.
- Interfere with, overload, or circumvent usage limits or security controls of the Service.
- Use the Service to harass, deceive, or harm others.
4. Recording consent and your responsibilities
Laws in many jurisdictions require the consent of one or all parties before a conversation may be recorded or transcribed. Because Jottey is invisible to other participants, obtaining any legally required consent is entirely your responsibility.
You represent and warrant that, for every call you capture, you have all rights and consents necessary to record, transcribe, and process that conversation and its participants’ data. You agree to indemnify and hold us harmless from any claim, liability, or expense arising out of your recording or use of the Service in violation of applicable law or these Terms.
5. Plans, billing, and coaching minutes
The Service is offered on free and paid plans. Paid plans are billed through Stripe on a recurring (monthly or annual) basis until cancelled.
- Coached minutes measure the time Jottey is live and coaching on your calls. Each plan includes a monthly allowance that resets at the start of each billing period and does not roll over.
- Where enabled, usage beyond your allowance may be billed as overage at the rate shown at checkout.
- Fees are charged in advance and, except where required by law or expressly stated, are non-refundable.
- You can cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
- We may change pricing prospectively; we will give reasonable notice before changes affect your plan.
6. Free access, early access, and beta features
We may offer complimentary, trial, early-access, or beta access at our discretion. Such access may be limited, changed, or withdrawn at any time. Beta features are provided “as is,” may be unstable, and may be discontinued.
7. Third-party services
The Service depends on third-party providers, including Recall.ai (capture and transcription), OpenAI (AI coaching and analysis), Google (sign-in), and Stripe (payments). Your use of the Service is also subject to those providers’ terms, and we are not responsible for their acts or omissions. See our Privacy Policy for how data is shared.
8. Intellectual property
We and our licensors own the Service and all related software, content, and trademarks. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. As between you and us, you own your call content (your audio, transcripts, and the configuration you provide); you grant us the rights necessary to operate and provide the Service to you.
9. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. Coaching suggestions, extracted facts, and scorecards are generated by AI and may be inaccurate or incomplete. You are responsible for your own decisions and statements on a call; do not rely on the Service as a substitute for your professional judgment.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim, or USD $100.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (including Sections 4, 8, 9, 10, and 12) will survive.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to arbitration or small-claims resolution.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.
